Vendor Terms and Conditions

1. Application and Approval
• All vendors must submit a completed application on or before the deadline to be considered. Application fees are non-refundable.
• All applicants are subject to the selection process. Approval is contingent upon compliance, availability of space and jury decision.
• An Acceptance Letter provided by festival organizers will serve as an invitation to participate.
2. Booth Fees
• All vendors must pay the specified booth fee by the designated deadline or risk losing their space to a waitlisted vendor.
• Booth fees are non-refundable and are billed upon acceptance.
• Food vendors agree to pay Blissfest 10% of gross sales within 30 days of the event. Past due payments will be assessed a $50 penalty each month a balance remains. 
3. Booth Space
• Each vendor will be assigned a designated location and booth size.
  *We cannot accommodate all requests for specific locations and oversized booths, but do take requests into consideration.
• Vendors must adhere to set-up and breakdown schedules provided by festival organizers and outlined in the Acceptance Letter.
• All vendors are responsible for cleaning up their booth area and removing all waste. Recycling and composting is mandatory.
4. Permits, Licenses & Other Requirements
• Vendors are responsible for identifying and obtaining all necessary permits and licenses required by local authorities.
• Proof of permits and adequate licensing must be submitted to festival organizers prior to the event.
• Vendors agree to comply with county electrical, fire department, health department and Blissfest Music Organization rules.
5. Safety & Insurance
• Vendors are required to carry general liability insurance.
• Food vendors must adhere to all health and safety regulations, including food handling and preparation guidelines. Instructions for scheduling health department inspections are included in the Acceptance Letter
6. Product & Service Restrictions
• All products and services offered must be pre-approved by festival organizers
• Vendors may not sell or promote prohibited items; no weapons or paraphernalia
• All craft products must be handmade by you (or your employees) and must match the selection and quality presented in jury photos
• Nothing with the Blissfest name or logo may be sold outside of the Festival Store
• All food menus must have prices clearly posted
7. Conduct & Behavior
• Vendors and their employees or guests agree to abide by Blissfest policies, code of conduct, rules and other guidelines
• Vendors are expected to maintain a professional demeanor and promote a positive and family friendly atmosphere leading up to, during and post festival 
• Any form of harassment or disruptive behavior will not be tolerated
8. Electrical & Equipment Needs
• Vendors requiring electricity must specify this in their application
• All equipment must be safe and in good working condition
• Craft and healing arts vendors do NOT have access to electricity. You are not permitted to use electrical plugs to power your booth even if one is nearby.
• WIFI is provided on site but its reach is limited and a strong connection will likely not be accessible from your booth. ATT is the most reliable cellular provider at the festival property. PLEASE PLAN AHEAD. 
9. Sales & Transactions
• Vendors are responsible for collecting their own sales tax and maintaining accurate sales records.
• Cash, credit, and other payment methods must be clearly communicated to customers along with any applicable fees.
10. Cancellation Policy
• Vendors must notify festival organizers in writing ASAP if they wish to cancel.
• No call, no shows will not be considered for future festivals.
• There are no refunds for cancellations, but BMO may consider a future credit in certain circumstances with proper documentation.
11. Liability Waiver
• All vendors, their representatives, employees and guests consent to the BMO RELEASE AND WAIVER OF LIABILITY AGREEMENT when they choose to participate in this event. Please review this agreement in full prior to confirming your participation.
12. Termination of Agreement
• Failure to abide by these terms and conditions, as well as general festival rules and the Blissfest Code of Conduct may result in immediate expulsion from the festival and revocation of credentials without a refund.
13. Amendments
• Festival organizers reserve the right to amend these terms and conditions at any time. Vendors will be notified of any changes.

BMO Terms and Conditions/ Liability Waiver

RELEASE AND WAIVER OF LIABILITY AGREEMENT

In consideration for voluntarily applying for and/or participating in the Blissfest Music Festival and all events, volunteer activities, setup and takedown, and any related gatherings or travel associated with the Blissfest (hereinafter referred to as “Activity”), I hereby RELEASE, WAIVE, COVENANT NOT TO SUE, AND AGREE TO HOLD HARMLESS for any and all purposes Blissfest Music Organization, the Board of Directors, the State of Michigan, officers, agents, employees, volunteers, third-party or independent contractors, vendors, and performers (hereinafter referred to as “RELEASEES”) from any and all liabilities, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, while participating in such Activity, while on the premises where the Activity is being conducted, or in transportation to and from said premises, WHETHER CAUSED BY MY OWN NEGLIGENCE, GROSS NEGLIGENCE, OR THE NEGLIGENCE OR WILLFUL MISCONDUCT OF RELEASEES OR ANY OTHER PERSON, IN WHOLE OR IN PART.

 

ACKNOWLEDGEMENT OF RISK

I am fully aware that there are inherent risks to myself and others involved in the Activity that may result in personal injury, illness, or death, caused by: (a) engaging in the Activity or events associated with Activity; (b) traveling via any means of transportation to or from the Activity or during the duration of the Activity; (c) exposure to or use of materials, tools, supplies, equipment, machinery, or other items associated with or utilized during the Activity or related activities; or (d) exposure to other dangerous conditions associated with the Activity. I acknowledge that potential hazards may include severe weather events, flood, fire, trees, tripping hazards, controlled substances, assault, terrorism, or weapons. I voluntarily participate in this Activity with full knowledge of these hazards and ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH. I understand that the RELEASEE does not require my participation in this Activity, but I choose to do so despite the risks. I acknowledge there may be physically strenuous activities, and I know of no medical reason why I should not participate.

 

COMPLIANCE WITH RULES AND POLICIES

I agree to abide by all Blissfest policies, rules, and instructions given by Blissfest Music Organization staff, agents, or volunteers to ensure the safety and well-being of all participants. Failure to adhere to these rules may result in my removal from the Activity without any refund or recourse. All attendees consent to a reasonable inspection of their belongings prior to entry and/or during their presence on the premises to ensure compliance with festival rules. NO WEAPONS are allowed on the Blissfest property, and failure to adhere to this rule may result in immediate expulsion without refund. Wristbands and/or tickets are a revocable license granting access to Blissfest events, and Blissfest Music Organization reserves the right to revoke access for rule violations or misconduct at any time. All ticket sales are final; there will be no refunds or exchanges. Lost, stolen, or damaged wristbands are the responsibility of the attendee. Wristbands may not be resold or duplicated.

 

MEDIA RELEASE CLAUSE

I hereby grant Blissfest Music Organization the right to photograph, record, and broadcast my image for any lawful purpose, including promotional or educational purposes, in any medium, without compensation. By attending, I authorize Blissfest Music Organization to reasonably use my image or likeness in any live or recorded transmission or reproduction of the event, which may be used to promote Blissfest Music Organization in the future.

 

CONTAGIOUS ILLNESS

Blissfest Music Organization aims to deliver its mission while protecting the health and safety of the community and minimizing the potential spread of disease. On- and off-site experiences, like any other activity that exposes an individual to the public, present a risk of exposure to contagious diseases or viruses, including but not limited to COVID-19 or other emerging health risks. By participating in this Activity, I acknowledge and accept these risks. This assumption of risk includes exposure risks present before, during, or after the Activity, regardless of the cause or alleged cause. I agree to follow Blissfest Music Organization’s, the CDC’s, and any applicable federal, state, and local health and safety protocols, including any disclosure, distancing, quarantine, personal protective equipment (PPE), or temperature monitoring requirements. I agree to monitor my own personal health status and determine whether participation in this Activity is in my best interest. I accept that Blissfest cannot ensure an environment free of contagions and assume full responsibility for any exposure risks.

 

MEDICAL TREATMENT

I hereby consent to any medical treatment that may be required due to any injury or illness arising out of participation in this Activity or related activities. I acknowledge that Blissfest Music Organization does not provide health or accident insurance for participants engaged in this Activity or related activities and voluntarily assume all financial responsibility for such medical treatment. I understand and agree that Blissfest Music Organization has no duty to provide medical treatment or assistance. I am advised to obtain my own medical coverage before participating in this Activity.

 

GOVERNING LAW/VENUE

This Agreement shall be construed in accordance with the laws of the State of Michigan. If any term or provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the maximum extent permitted by law, with any necessary modifications to ensure enforceability. I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Michigan. The sole proper place of venue for any dispute arising out of this Agreement shall be in Emmet County, Michigan.

 

PARENTAL CONSENT

Blissfest attendees under the age of 18 must be accompanied by their guardian or other designated adult. By accompanying a minor attendee, I certify that I am the parent, legal guardian, or temporary guardian of the minor, with full legal authority to consent to this agreement on their behalf. I accept and assume all risks, including personal injury or illness, that may arise from the minor’s participation in the Activity.

 

INDEMNITY

I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS RELEASEES FROM ANY AND ALL LOSSES, LIABILITIES, CLAIMS, DEMANDS, INJURIES (INCLUDING DEATH), OR DAMAGES, INCLUDING COURT COSTS AND ATTORNEY’S FEES AND EXPENSES, WHICH MAY OCCUR TO MYSELF, OTHER PARTICIPANTS, OR MY PROPERTY, OR ANY CLAIMS BROUGHT BY THIRD PARTIES DUE TO MY ACTIONS ARISING OUT OF MY PARTICIPATION IN THIS ACTIVITY, WHETHER CAUSED BY MY OWN NEGLIGENCE, GROSS NEGLIGENCE OR THE NEGLIGENCE OR WILLFUL MISCONDUCT OF RELEASEES OR ANY OTHER PERSON, IN WHOLE OR IN PART.

 

ELECTRONIC SIGNATURE

By participating in this event, I acknowledge and represent that I have read, understood, and voluntarily agree to the terms set forth by this agreement. No oral representations, statements, or inducements apart from the terms contained in this Agreement have been made. I fully intend to be bound by the terms of this Agreement now and in the future. I agree that my electronic or online acknowledgment of this agreement has the same legal effect as a handwritten signature.
